Business of Occupiers
Kharkiv
The judicial system has sold out to raiders and criminals working with the Russian Federation? The story of Solly Plus car holding
Kharkiv residents, who suffer daily from enemy shelling, are now in the crosshairs of their own compatriots. First, Russian CABs, missiles that terrorized Saltivka on a daily basis, and now the TCC raids and full mobilization of the population. But this is not the end. They want to demolish the market, which employed more than 150 people, and take over the land by raiding it. And this is at a time when the population of Kharkiv needs jobs.
We are talking about a large plot of land at 323-A Akademika Pavlova Street. It currently houses a large shopping center with a bus station, in which more than UAH 200 million was invested. However, now both the property and hundreds of officially employed citizens are under threat.
Cover-up of raiding by Kharkiv judges
2012. Solli sells a land plot together with unusable real estate to Bezant. The latter immediately resells the land plot to Polipharm and ceases operations.
2017. The legal owner of the land plot is Briand, which buys the land from Polipharm.
2023. Suddenly, Oleksandr Gapon, a co-owner of Solli, appears and claims that the decision to sell the land in 2012 was made illegally. He filed a lawsuit with the Economic Court of Kharkiv Region demanding that the decision of Solli’s executive body and the original purchase agreement between Solli and Bezant be invalidated.
The judge in the case was Yevhen Zhilyaev, who ruled in favor of Gapon in December 2023, satisfying the claim in full.
2024. Solli files a new lawsuit with the Economic Court of Kharkiv Region demanding to reclaim the land from Briand. This time, the judge is Natalia Kukhar, who, based on Zhilyaev’s decision, orders the land to be returned to Solli.
At the same time, all the proceedings were accompanied by numerous manipulations, such as postponement of court hearings, violation of the statute of limitations (after all, 12 years have passed since the land was transferred to Polypharm. So, we have obvious abuses by judges and their desire to cover up the raiding at Saltivka.
We have filed a complaint with the High Council of Justice to put an end to the abuse. We will be closely monitoring the activities of these judges.
To recap: “Solli is a part of the Solli Plus group of companies, headed by Konstantin Tokarev, a former member of the Kharkiv City Council from the Party of Regions.
The media have repeatedly reported that Solli Plus was involved in cooperation with Russia and Belarus. In particular, it was about organizing a scheme to smuggle cars and spare parts from the territory of the aggressors. According to the scheme, products manufactured by GAZ (Russia) and MAZ (Belarus) are allegedly imported into Ukraine in violation of customs legislation. The members of the criminal organization evade customs duties and taxes, causing millions of hryvnias in losses to the state.
The cars are transported by car carriers through neighboring countries: Poland, Hungary, Slovakia, Romania and Moldova. The importation is carried out by individuals controlled by Tokarev, who receive funding to cover fuel and maintenance costs.
A chronicle of judicial arbitrariness
We submitted materials to the list of authorities. And while some of them have already started pre-trial investigations, such as the Shevchenkivskyi District Prosecutor’s Office of Kharkiv – No. 42024222060000195 under Part 1 of Article 364 of the Criminal Code of Ukraine, others continue to cover up for the Sollie raiders.
The investigating judge of the Kyiv District Court of Poltava, Yakovenko N.L., refused to oblige the TU BES in Poltava region to enter information into the URPTI (case No. 552/7766/24).
Investigating judge of the Solomyansky District Court of Kyiv I. Teslenko refused to oblige the Solomyansky District Prosecutor’s Office of Kyiv to open an investigation (case No. 760/24055/24).
The same decision was made by the investigating judge of the Novozavodsk District Court of Chernihiv regarding the Chernihiv Regional Prosecutor’s Office (case #751/8711/24).
We will not stand aside and will continue to send materials, initiate investigations and accelerate the response of law enforcement.
We urge you to report similar manipulations, raiding, and concealment of crimes by judges.
