Tyshchenko and the corruption of Ukraine’s law enforcement and judicial systems. What awaits the Servant of the People and others like him?
The Tyshchenko case is a showcase for Ukrainians that will be forgotten in a week. Or why we are increasingly coming to this conclusion.
Yesterday was remembered for the loud discussion of the search and court hearing that took place as part of the case of Mykola Tyshchenko, the current MP from the Servant of the People party. All telegram channels and media outlets showed a video of the Auditor smashing his phone, his stunning quotes in the Pechersk District Court, and his rest in a restaurant after the round-the-clock house arrest. But will the case continue?
Given the volume of Tyshchenko’s “scandals,” the conclusion is automatic. Doesn’t everyone remember his trip to Thailand and his subsequent expulsion from the faction, but not the deprivation of his parliamentary mandate? In addition, Tyshchenko is still the deputy chairman of the Committee on Transport and Infrastructure.
How did it all start?
Dnipro, another raid by the MP on call centers, which, according to him, deceive the military, their mothers, and all Ukrainians in general. The main official mission was to stop the activities of the offices, but the real mission was to fly around them and establish a monthly fee.
All of Tyshchenko’s actions in Dnipro were allegedly carried out within the framework of the Verkhovna Rada’s PIC on call centers. But there is one caveat. The said PIC was created for a year and no longer exists. Moreover, Tyshchenko has never been a member of this PIC. His equally scandalous colleagues, Dmytruk and Kunytskyi, who, among other things, also committed crimes against the military, were members of the same commission but were never punished. And now the situation has repeated itself. But this time it went further.
All of this is due to the large-scale media publicity that has not subsided for several days in a row.
So, Tyshchenko, along with his own security and representatives of the Kyiv City Police (what were they doing in Dnipro?), including Bohdan Pysarenko, visited offices at 5 addresses: 19 Lyvarna Street, Dnipro, 96a Zaporizke Highway, and 2 Marshal Malynovskyi Street, Dnipro. According to Tyshchenko, these are the locations where the botanical farms were settled. In reality, no confirmation of his words was found.
Tyshchenko and his group then began to demand money in the amount of USD 1,000,000 to cover up their activities.
On the way to one of the offices, Tyshchenko met a military special forces officer, Dmitry Pavlov (Son), who is actually the head of the call center security service. This was followed by a conflict that spread across all social networks, during which the MP’s team used physical violence against the military officer.
Law enforcement response
The relevant authorized officials of the Main Department of the National Police in Dnipro region initiated a pre-trial investigation into the circumstances described under Art. 125 (intentional minor bodily injury) and Art. 146 (illegal imprisonment or abduction) of the Criminal Code of Ukraine.
Although, even at first glance, it is obvious that the qualification does not correspond to reality. After all, in these circumstances, there was an organized criminal group (Art. 255 of the CCU), which, among other things, included representatives of the Kyiv City Police, Territorial center for recruitment and social support, who abused their official position and powers (Art. 364 of the CCU), exceeding their authority (Art. 365 of the CCU), (and with respect to representatives of the Territorial center for recruitment and social support – Article 426-1 of the CCU) extorted money from the management of call centers in Dnipro (Article 189 of the CCU), including through beatings, illegal detention of military man Dmytro Pavlov.
It seems that the proceedings initiated by Dnipro law enforcement officers are nothing more than a formality to create the appearance of a fight and a reaction.
It should not be forgotten that Tyshchenko is (still) a member of parliament. With this in mind, his case has certain specifics. After all, all motions must be approved by the Prosecutor General, which sometimes complicates and delays the course of the case.
Search and arrest – a showcase – Tyshchenko’s personal stand-up?
The highlight of Tyshchenko’s case is the search and the court hearing.
Nothing new happened during the search. It was expected to see wads of currency, precious watches worth several million each. Tyshchenko’s reaction to the investigative actions was also obvious. Only the MP himself did not think that the moment when the phone was smashed would be recorded on video.
Then the court hearing began, and it turned into a personal stand-up show by the Servant. “The caravan barks”, a role model in ‘The Reviser’ and a winner of ‘Dancing with the Stars’ were the key quotes of yesterday.
In the end, a decision was made to impose a measure of restraint in the form of round-the-clock house arrest. But are such actions enough? It is possible that the measure of restraint could be changed to night detention or a personal commitment. We are not letting go of the option of “breaking” the bracelet.
But the MP’s bodyguard in the courtroom suddenly remembered his rights. At the moment when the situation affected his person. Why then did he not remember his rights when he and Tyshchenko were raiding and inflicting bodily harm on a military officer?
What’s next?
The only question is whether the case will be delayed. After all, the process can drag on for years until all the deadlines have passed.
As one political scientist rightly noted: “That is, we will talk about it a lot now, certain actions will be taken (they have already been taken), but the person will, firstly, retain his mandate; secondly, he will have the opportunity to somehow, I will not say that he will influence the investigation, but to do at least those things that he did before. And then, against the backdrop of some other topics that are much more important for Ukraine and Ukrainians, this story will fade into oblivion somewhere. And, most likely, it will not have a logical continuation in the form of a court decision or a court verdict.”
And the point is not even that Tishchenko was “leaked” to calm the masses. It is obvious to everyone that there will be no further development of events: no imprisonment for Tyshchenko. But the realization that people are not ready to be silent and need changes is a rather serious signal to the authorities. It is worth considering.
In addition, I wonder what fate will befall the law enforcement officers and employees of the Territorial Recruitment Center who raided the offices together with Tyshchenko? Why is the top leadership of the National Police and the Military Law Enforcement Service still silent? Or are they not so media-savvy as to make a show of it? Or will such actions tarnish their already tarnished reputation and prevent them from covering up the activities of call centers?
We demand that the system of law enforcement agencies, TCCs and JVs, and the like, be brought to order. How much more resonance does it take for you to finally come to your senses and wake up?
