Klitschko, Palatnyi and Komarnytskyi – a gangster trio to seize land and the Kyiv budget

Denys Komarnytskyi, who is wanted by the NABU and is still successfully hiding from the investigation, is the main “watchdog” of the capital, controlling all key departments responsible for construction in Kyiv. Through his proteges in the commissions of the Kyiv City Council and municipal enterprises, he directs the processes in the right direction, which helps to make decisions favorable to the businessman regarding the allocation of land plots or the distribution of wins in public procurement.

Another important figure in Komarnytskyi’s schemes is Artur Palatnyi, who provides connections between the “watchdog” and Kyiv Mayor Vitali Klitschko, as well as with law enforcement agencies. It is thanks to this combination of the highest echelons of power that the system operates continuously and virtually without interference.

Back offices and black cash of Klitschko and Palatnyi

To ensure the financial part of construction projects in the capital, there is an extensive network of back offices that work as a channel for the exchange of illegal funds. Some of them are focused on accepting money for construction permits, while others are involved in preliminary processing of documents. However, the most interesting part of this network is Olena Marchenko. She is a member of the Kyiv City Council from the Batkivshchyna party and coordinator of all construction schemes due to her proximity to Komarnytskyi. It is Marchenko who actively manages the activities of departments and commissions that determine the course of construction projects. Not so long ago, Marchenko became a defendant in the NABU and SAPO case on land corruption in Kyiv. The investigation directly pointed to her ties to Komarnytsky.

Key players in the “land field”

According to the NABU investigation, the key players in land issues were Petro Olenych, the deputy mayor in charge of land resources, and the aforementioned Marchenko, who controls allocations through the Kyiv City Council’s Land Commission. Interestingly, Olenych himself has repeatedly stated in interviews that he is a “fighter for the land of Kyiv residents.” However, not a single land decision in Kyiv is made without his participation, and it is he who oversees the land carve-up associated with major construction projects.

And all of this has been going on for years under the cover of Mayor Klitschko, his right-hand man Palatnyi, and a long list of officials from the Kyiv City State Administration and Kyiv City Council. Well, one hand washes the other, as usual…

NABU searches: when is the culmination?

The searches in the offices of Komarnytskyi and other defendants in the case relate to numerous land frauds where Komarnytskyi and his partners received significant income. However, this is only part of a larger scheme. In order for corruption to reach such a scale, not only land fraud was involved, but also construction tenders, the allocation of budget funds for public projects, and even abuse of the budgets of public utilities.

A key role in all of these processes, among others, was played by Olena Bohoslavska, Komarnytskyi’s confidant, who helped organize all of this within the walls of Kyiv’s bureaucratic offices. She is a kind of “scheme organizer” who sent tasks to various representatives of utility companies, customers and officials to ensure the smooth implementation of these corrupt plans.

We should not forget about such “distributors” of money as Artur Palatnyi, Yuriy Romanyuk and Viktor Tynnyi, who throughout their careers became “funds” for this corrupt structure.

Komarnytskyi’s schemes: what is known?

One of the largest schemes involving Komarnytsia is the Podilskyi Bridge project, where the general contractor is Eco Bud Trade, a company controlled by the man. This project has become a symbol of Kyiv corruption, as it used all methods, including manipulation of tenders and cash flows.

Although law enforcement officers made several attempts to “wean” Komarnytskyi from the capital’s budgetary schemes. For example, in May 2023, the Kyiv City Prosecutor’s Office submitted an indictment against the head of the general contractor organization on the fact of embezzlement of more than UAH 36 million to the court. It was a case of overstating the cost of renting construction machinery and equipment by almost UAH 104 million including VAT.

And in September 2023, law enforcement officers recorded losses of UAH 6.5 million during the purchase of sand for the construction of a bridge.

In addition, the General Directorate of the Security Service of Ukraine initiated a pre-trial investigation in criminal proceedings No. 22024000000000523 under Part 1 of Article 364 of the Criminal Code of Ukraine, and the BES in Kyiv registered a criminal case in the URPI under No. 42023140000000282 under Part 3 of Article 212 of the Criminal Code of Ukraine.

However, as we can see, real measures to eliminate Komarnytskyi’s influence on the construction and land sectors of the capital have only now begun to be implemented.
